These Terms and Conditions ("Terms") govern your access to and use of the Doqett website located at https://www.doqett.com (the "Website"), mobile application (the "App"), and all associated services, features, content, and functionality offered by Doqett Labs Pvt. Ltd. ("Doqett", "we", "us", or "our").
1. Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Platform. These Terms apply to all users of the Platform, including but not limited to browsers, students, instructors, mentors, and any other contributors of content.
2. User Accounts
2.1 Account Creation
You may need to create an account ("Account") to access certain features of the Platform. When creating an Account, you are responsible for providing accurate and complete information. You are solely responsible for maintaining the confidentiality of your Account information, including your login credentials, and for all activities that occur under your Account. You agree to notify Doqett immediately of any unauthorized use of your Account or any other security breach.
2.2 User Eligibility
We recognize the importance of parental involvement in a child's online learning journey. If you are under 18, you must have your parent or legal guardian's permission to access and use the Platform. By using the Platform, you represent and warrant that you meet all of the foregoing eligibility requirements.
3. Content Ownership
The Platform contains content owned or licensed by Doqett, including course materials, text, graphics, logos, images, software, and other information ("Content"). Content also includes User Content (defined below). Content is protected by copyright, trademark, and other intellectual property laws.
3.1 Use of Content
You may not modify, publish, distribute, transmit, create derivative works of, or commercially exploit any Content without Doqett's prior written consent. You may access and use the Content for your personal, non-commercial use only.
3.2 User Content
You may be able to submit content to the Platform, such as forum posts, comments, assignments, project materials, or other materials ("User Content"). You retain all ownership rights to your User Content, but you grant Doqett a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute your User Content on the Platform and for promotional purposes. You are solely responsible for your User Content and represent that you have the necessary rights to grant the license set forth above. You further agree that your User Content will not violate any applicable law or regulation, infringe on the rights of any third party, or be harassing, abusive, obscene, defamatory, or threatening.
4. Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Platform in any way that violates any applicable law or regulation.
- Infringe on the intellectual property rights of Doqett or any third party.
- Transmit any harassing, abusive, obscene, defamatory, or threatening content.
- Interfere with or disrupt the Platform or servers or networks connected to the Platform.
- Use the Platform for any unauthorized commercial purpose.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Collect or store personal information about other users without their express consent.
- Use the Platform to upload or distribute viruses, malware, or other harmful code.
- Engage in any automated use of the Platform, such as using scripts or bots.
5. Third-Party Content and Services
The Platform may contain links to third-party websites or services ("Third-Party Content and Services"). Doqett is not responsible for the content or practices of any Third-Party Content and Services. Your use of Third-Party Content and Services is at your own risk. We encourage you to review the terms and conditions and privacy policies of any Third-Party Content and Services before using them.
6. Fees and Payment
6.1 Free and Paid Courses
Doqett offers a variety of courses, some of which are free and some of which require payment. You will be informed of the price of a course before you enroll.
6.2 Payment Processing
We may use a third-party payment processor to process your payments. You agree to comply with the terms of service of any third-party payment processor.
6.3 Refunds
Doqett offers a refund policy for certain courses within a specified timeframe of enrollment. The specific refund policy will be available on the course description page in respect to the course. To request a refund, please contact Doqett support at support@doqett.com.
6.4 Payment Terms
You are responsible for all charges incurred on your Account, including applicable taxes. Payment is due immediately upon enrollment in a paid course.
7. Disclaimer
The Platform and all Content are provided "as is" and without warranties of any kind, express or implied. Doqett disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Doqett does not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform is free of viruses or other harmful components.
8. Limitation of Liability
Doqett will not be liable for any damages arising out of or related to your use of the Platform, including, but not limited to, direct, indirect, incidental, consequential, or punitive damages. You agree to indemnify and hold harmless Doqett, its officers, directors, employees, agents, and licensors from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or related to your violation of these Terms or your use of the Platform.
9. Termination
Doqett may terminate your access to the Platform at any time, for any reason, with or without notice. You may terminate your Account at any time by contacting Doqett support.
10. Governing Law
These Terms will be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms will be resolved through binding arbitration in accordance with the Arbitration Rules of the Kathmandu Valley Arbitration Center. The arbitration shall be conducted in Kathmandu, Nepal. The decision of the arbitrator shall be final and binding on all parties.
12. Entire Agreement
These Terms constitute the entire agreement between you and Doqett regarding your use of the Platform.
13. Changes to Terms
Doqett may revise these Terms at any time by posting the revised Terms on the Platform. You are responsible for checking the Terms periodically. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
